Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Gallery Room, including the website, applications, and related services (the "Service"). By creating an account, uploading content, purchasing access, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

These Terms include our rules on prohibited content. There is no separate content policy. If these Terms conflict with a marketing page, these Terms control.

2. Eligibility

You must be at least 13 years old to use the Service. If you sell access to a Room, you must also meet the minimum age required by Stripe and by the law that applies to you. The Service is not directed to children under 13, and we do not knowingly allow them to hold accounts.

3. Accounts

You must provide accurate information when you create an account. You are responsible for the security of your credentials and for all activity under your account. You must notify us promptly at hello@galleryroom.com if you believe your account has been compromised.

4. Your Content

You retain ownership of photos, videos, and other material you upload ("Content"). You grant Gallery Room a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, transcode, and distribute that Content solely as needed to operate, secure, and moderate the Service, including showing it to people you allow to access the Room.

You represent that you have all rights and consents needed to upload the Content and to grant this license, including the consent of every identifiable person where the law requires it. This license ends when the Content is deleted from the Service, except for copies we must retain to comply with law, resolve a dispute, or enforce these Terms.

5. Prohibited Content and Acceptable Use

You may not upload, post, request, purchase, share, or otherwise use the Service for any of the following. These rules apply to every Room, including locked Rooms and Rooms that require payment. Paying for access does not make prohibited content lawful or permitted.

• Sexual content and nudity. Pornography, sexually explicit material, and nudity. This includes sexual acts, genitalia, and content whose primary purpose is sexual arousal. It includes illustrated, animated, and photorealistic material.
• Sexual content involving minors. Any sexual content involving a minor, or any person who appears to be a minor. This prohibition has zero tolerance. It includes real, illustrated, animated, and synthetic material. We will terminate the account immediately, preserve evidence, and report to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement as required by law, including 18 U.S.C. § 2258A.
• Non-consensual and synthetic intimate imagery. Intimate imagery shared without the consent of every person depicted, sexual content shared without that consent, and deepfake or other synthetic sexual imagery of a real person.
• Gore and graphic violence. Gore, graphic violence, mutilation, torture, animal cruelty, and depictions of serious injury or death that are intended to shock.
• Self-harm. Content that promotes or depicts self-harm or suicide.
• Terrorism and violent extremism. Terrorism or violent extremism, credible threats of violence, and incitement to violence.
• Hate and harassment. Hate speech and harassment that target a person or group on the basis of a protected characteristic, including race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability, or similar status protected by applicable law.
• Illegal goods and activities. Content that promotes or facilitates illegal goods or activities, including illegal drugs, weapons trafficking, human trafficking, and fraud.
• Rights of others. Content that infringes copyright, trademark, privacy, or publicity rights, or that is otherwise unlawful under applicable law.

You also may not probe, scan, or test the vulnerability of the Service, interfere with another member's use, evade access controls, or use the Service to collect personal information without authority.

6. Moderation and Enforcement

We use automated tools and human review to enforce these Terms. Uploaded photos and videos are scanned before they are shown to the public or made available for purchase. If a scan flags content, or if a scan fails or times out, we hold the content for review. It stays hidden until we approve it.

We may remove or refuse content, withhold or reverse earnings that are tied to content that violates these Terms, suspend or terminate accounts, and preserve records. We may cooperate with NCMEC and with law enforcement, and we may disclose content and account information when the law requires it or when we believe disclosure is reasonably necessary to protect a person from harm.

Suspected sexual content involving a minor is blocked. We do not publish it automatically. We preserve it for legal reporting.

7. Reporting

If you see content that violates these Terms, report the Room from the Room page or email hello@galleryroom.com. Include the Room address, a description of the problem, and, if you can, the time and place of the material. We review reports and may remove content or suspend the account. A creator whose content is rejected may appeal that decision from the product where an appeal is offered.

8. Copyright and Repeat Infringement

We respond to notices of copyright infringement that meet the requirements of the U.S. Digital Millennium Copyright Act ("DMCA"). If you believe content on the Service infringes your copyright, send a notice to hello@galleryroom.com that includes: your physical or electronic signature; identification of the copyrighted work; identification of the material and information reasonably sufficient for us to locate it; your contact information; a statement that you have a good-faith belief that the use is not authorized; and a statement, under penalty of perjury, that the notice is accurate and that you are the owner or are authorized to act for the owner.

If we remove material in response to a notice, we may notify the member who posted it. That member may send a counter-notice that meets DMCA requirements. We may restore the material if the requirements of the DMCA are met.

We terminate, in appropriate circumstances, the accounts of members who are repeat infringers. We may also limit or terminate an account after a single serious violation.

9. Payments

Payments for paid Rooms are processed by Stripe. When you set a price for a Room, you agree to Stripe's terms. Gallery Room may charge a platform fee on a transaction. The fee is disclosed before you publish a paid Room. You are responsible for taxes on amounts you receive.

We may withhold, reverse, or refund earnings that are tied to content or conduct that violates these Terms, including after a payout has been requested. Access that was granted because of a payment may be revoked if the underlying content is removed for a violation.

10. Intellectual Property

The Gallery Room platform, including its design, code, and branding, is owned by us or our licensors. You may not copy, modify, or distribute any part of the platform except as these Terms allow. These Terms do not transfer any of that ownership to you.

11. Account Deletion

You may delete your account at any time from your account settings. When you delete your account:

• Your profile, rooms, and uploaded media are deleted, except material we must keep for a legal report, a dispute, or another legal duty.
• Your purchase history is removed, except records we must keep for tax or accounting.
• A pending payout is processed before closure where that is possible and where these Terms do not require us to withhold it.
• Deletion of the account is irreversible.

12. Termination

We may suspend or terminate your account if you violate these Terms, if we are required to do so by law, or if we reasonably believe your use creates risk for us, for other members, or for a third party. You may stop using the Service and delete your account at any time. On termination, your content may be deleted after a reasonable retention period, except where we must retain it as described in these Terms.

13. Disclaimers

Gallery Room is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted access, that the Service will be error-free, or that moderation will detect every violation.

14. Limitation of Liability

To the maximum extent permitted by law, Gallery Room and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from your use of the Service. Our total liability for a claim arising out of the Service will not exceed the greater of the amount you paid us in the three months before the claim or fifty U.S. dollars. Some jurisdictions do not allow these limits. In those jurisdictions, the limits apply to the fullest extent the law allows.

15. Governing Law

These Terms are governed by the laws of the United States and, to the extent state law applies, the laws of the state in which the operator of the Service resides, without regard to conflict-of-law rules. Courts in that location have exclusive jurisdiction, except that we may seek injunctive relief in any court of competent jurisdiction. If you are a consumer outside the United States, mandatory local law may give you rights that these Terms cannot waive.

16. Changes

We may update these Terms. We will change the "Last updated" date when we do. If a change is material, we will provide additional notice, such as an email or an in-product message. If you continue to use the Service after the update takes effect, you accept the updated Terms.
